Victim is a manager of a propane company and stated a lost gas card was used to purchase 895 gallons of diesel fuel and 131 gallons of unleaded gas which occured from Feb 2008 through May 2008.  Victim stated the fuel was purchased at a gas station on Pacheco Street which the company never uses during the time the fuel card was being used two employees were hired in Feb 2008 who are no longer employed with the company and the card has since been cancelled.

Suspect: Ernesto Lozano                Age:36          Arrest Location: Rufina/ Jemez

Charges: DWI, Driver must be licensed No insurance/ Improper use of plate.

Lozano was observed failing to maintiain his lane of travel and almost struck another vehicle head on. Upon contact with Lozano he showed signs of Impairment and was adminstered the Standardized Field sobriety Test and placed under arrest fror showing signs of Impairment. Lozano admitted to consuming 5 to 6 beers prior to operating the vehicle.  Lozano was advised of the New Mexico Implied consent act and agreed to take submit to the breath test. First breath test was improper sample and second breath result was .27.

Deputy York met with victim who stated an ex-employee opened an unsecured loan account under his name using his credit card. Victim stated he was not aware of the account until he was informed by his banks fraud division concerning other charges.  Victim stated he has been charged $39.95 a month since October of last year 2007 totalling $359.55.  Card has since been cancelled.

On 6/09/2008 victim came to Sheriffs Office and stated on 06/02/2008 he returned to his residence and found his ex-wife in his house.  Victim stated he went to call the police and his ex-wife left the residence.  Victim stated a check of his residence revealed diamonds rings, earrings, watches, braclets, leather pants, chaps and vest and a camp stove missing totalling $2900.00.

Reporting Party (husband) stated wife left the house on 06/08/2008 and called him and stated she was fine and that she was crusing around. Husband stated wife did not inform him of where she was going or who she was with and has not heard from wife since she called.  Wife was entered into the National Crime Information center as missing.

Victim stated she went to the Cities of Gold Casino with a coworker 06/01/2008. After a few alcoholic drinks she was taken to coworkers boyfriends house which is an unknown location to victim.  Victim stated coworkers boyfriend Criminally Sexually Assaulted her at coworkers boyfriends home.

Suspect: Rueben Garcia    Age: 45     Arrest Location: Cerrillos Road/ Ocate Road

Suspect was observed failing to use his signals while changing lanes.  Traffic stop was initiated with the vehicle. Upon contact with driver/ suspect showed signs of impairment. Suspect was administered the Standardized Field Sobriety Test and placed under arrest for showing signs of impairment.  Suspect was read the New Mexico Implied Consent Act and agreed to give a breath sample. First breath sample results .06 and second breath sample .06. Check of suspects driving history showed he has 6 prior DWI and the plate being displayed on the vehicle did not belong to the car.

Victim was attending church betweet the hours of 11:30 AM and 12:30 PM on Sunday 06/08/2008.  Upon her return to the vehicle she observed the back passenger side rear window was broken and her purse had been rummaged through.  Victim stated her credit cards were taken from the purse which have been cancelled. No suspect or witness information available at this time.

Victim stated sometime during the night between 06/05/08 to 06/06/08. Unknown person(s) gained entry into his vehicle a 1996 Dodge Intrepide through the passenger side door and stole the faceplate to his radio valued at around $100.00 dollars.  There is no suspect information available at this time

On Saturday June 7, 2008 at around 1:40 PM, Victim left his place of business and secured it with a lock.  Victim went to the shell gas station on Airport to get a drink. On his return at 1:55 PM, he observed a male dark short hair, grey shirt and shorts placing items into his truck from his business. Victim tried to keep suspect from leaving but was unable to do so.  Victim noticed that a Black 10" makita saw, grey 25 gallon air compressor, batteries and various tools were taken from his business valued at around $800.00.  Victim stated lock was cut with a pair of bolt cutters and suspect was driving a Blue Ford Expedition.
