On 8-29-2009 at 3:20 PM, Driver #1 was operating Vehicle #1 south at the location. Driver #2 was operating Vehicle #2 north at the location. Driver #1 fell asleep and allowed Vehicle #1 to cross left of the center divide line. Driver #2 initiated evasive action (steering to the right) to avoid Vehicle #1. As a result Vehicle #2 left the roadway on the right side. Driver #2 over corrected at which time she lost control of Vehicle #2 and rolled two times. Driver #2, who was not wearing a seat belt, was ejected from the Vehicle. Driver #2 was transported to Christus St. Vincent Regional Medical Center and admitted. There was no apparent signs of impairment for Driver #1. Driver #2's sobriety is unknown at this time, pending the results of a Blood Alcohol Test. Two chidren in Vehicle #2 were uninjured.

On the above date the victim reported that sometime betwee 08-28-09 8:00 PM and 08-29-09 12:30 PM her daughter and boyfriend stole several items from inside the residence. They both have a drug problem, the daughter lives there but the boyfriend is not allowed on the property.

DURING THE ARGUEMENT HE PUT A KNIFE TO HER THROAT AND TOLD HER TO MIND HER OWN BUSINESS OR HE WOULD KILL HER. THE SUSPECT FLED ON FOOT PRIOR TO OFFICERS ARRIVAL AND COULD NOT BE LOCATED. FURTHER INVESTIGATION INTO THIS INCIDENT IS PENDING.

On 8-29-2009 at 2:40 AM the suspect was operating the vehicle east at the location and was unable to maintain a single lane of travel. The suspect was found to be under the influence of an intoxicating liquor and had a Breath Alcohol Content of .16 or greater. A check with the New Mexico Department of Motor Vehicles revealed no driver's license on file for the suspect.

On 8-29-2009 at 10:31 PM the suspected was operating the vehicle at the location when he entered a DWI Check Point. The suspect was found to be impaired. After submitting to the Breathalyzer Test, the suspect was transported to Christus St. Vincent Regional Medical Center for a Blood Alcohol Test after the the results of the Breathalyzer Test were not consistent with the level of impairment displayed by the suspect during the Standardized Field Sobriety Test. The results of the Blood Alcohol Test are pending.
